63A: Clause 28, page 21, line 14, at end insert—

“6 Paragraph 5 does not apply in relation to an alleged offence under section 44, 45 or 46 that relates to conduct involving—

(a) the intentional unlawful killing of a person,

(b) torture or inhuman, cruel or degrading treatment or punishment, or

(c) the violation of a person’s sexual integrity.

7 Paragraph 6 does not prevent a decision not to prosecute in the public interest.”

Member’s explanatory statement

This probing amendment would ensure that the immunity provided to Ministers and officials who assist or encourage crimes under the Serious Crime Act 2007 does not cover torture, murder or sexual offences.
