It is far better. I ask the Secretary of State: what is the difference between a code and a rule? If, as he seemed to imply—at least, that was what I inferred from what he said—there is not a difference, then why persist with it? The other, and far more important point, which my right hon. Friend the Member for North-West Hampshire raised in his amendment, is that clause 5(8) should be deleted. It really should.
