Counter-Terrorism Bill

The hon. Gentleman, with his contacts in Edinburgh, probably knows more about that than I do. The clause has fundamental procedural and constitutional implications. The Lord Advocate has absolute prosecutorial discretion over crimes committed in Scotland, and I see no good reason for changing that. The constitutional position of the High Court of Justiciary is protected by article 19 of the treaty of Union. Clause 27 undermines it in an unwarranted and unjustified way.
