Justice and Security (Northern Ireland) Bill

I agree that new clause 5 gives the Secretary of State the power to set up the Department. However, it does not give the Secretary of State the power to devolve policing and justice powers to that Department. There may be a shell of a Department, but it cannot do anything until the powers are devolved to it. I hope that I have made my understanding of the legislation very clear. If I have erred on a particular issue, I am sure that the Minister will put me right.
