I raised this issue with the Minister earlier, and he has kindly agreed to come back to us on it later. I want to draw the attention of my hon. Friends in the Democratic Unionist party to subsection (5) of the new clause, which provides that the Secretary of State may establish a new Department if"““there is no reasonable prospect that the Assembly will pass an Act of the kind described””"
in subsection (2) of the new clause. Subsection (2) overrides subsections (1) and (2) of the Northern Ireland (Miscellaneous Provisions) Act 2006. I do not have the benefit of the technical support that the Minister has, but as far as I can see, this means that the only Act that will now be applicable is the one referred to in subsection (2) of the new clause.
