I am interested to note that my noble friend Lord Lucas has raised some of these issues. Here we are getting into the whole question of judgment, which is a difficult area of legislation. The question raised is whether or not substantial suffering has been caused. The same is possibly true with subsections (1)(d) and (2)(d), in which provision is made for where the suffering is unnecessary. Can the Minister tell us whether the word ““unnecessary”” is defined somewhere? Certainly it is true to say that in the treatment of farm animals there is a definition of what is necessary, but are we entering here into an area in which a judgment will have to be made on what is ““unnecessary””?
