I wonder whether I have got the Minister’s reply clear. It has been said that the clause will not amend the law and therefore the courts will take the same view of negligence and of standard of care. Therefore, all the legislation is doing is providing the court with an aide mémoire which says, ““Please don’t forget (a) and (b) when you are doing your normal job””. If the clause is merely an aide mémoire that would at least clarify where we are in relation to it.
