My name appears on the Marshalled List in support of Amendment No. 178. I had originally tabled my own amendments, which I subsequently withdrew simply because, although they tried to achieve the same objective, I thought that they were inferior to that of the noble Lord, Lord Phillips. I had required the consent to be written but I appreciate that his broader use of the word ““express”” covers consent in all its forms where one is positive that the consent has been given. I agree with him that one needs to have proof that consent has been given to ensure proper administration of the system.
