The noble Baroness raised a very interesting point. The Minister cited as examples abandonment or sale to someone else. Those are in effect actions by people. I realise that abandonment might not seem active, but the people concerned have decided to withdraw from exercising their rights. The noble Baroness’s example included, if I heard her correctly, encroachment by the sea, which is not active, but something which happens to people through a force well beyond their control. Would that sort of situation therefore be dealt with in a different way?
