It depends on what the noble Lord means by “out of control” and what content the bot is producing. If he does not mind, this may be an issue which we should go through in technical detail and have a more free-flowing conservation with examples that we can work through.

Providers will consider contextual evidence such as the circumstances in which the content was created or information about how the bot normally behaves on the site. In many cases, the person who “owns” the bot may be the same person who controls it. In such instances, providers will be required to consider the conduct and mental state of the owner when considering whether the relevant bot has produced illegal content.
Where the ownership of the bot is relevant, it will already be captured by this clause, but I am very happy to kick the tyres of that with the noble Lord and any others who wish to join us.
