Armed Forces Act (Continuation) Order 2015

Perhaps I should clarify. I understand fully the point that the noble Earl has made. Is the Minister saying that it would be impractical to undertake military action because there would be no duty to obey commands, or is it also the case that if this order

was not passed it would be illegal for our Armed Forces to undertake any action? Is it an issue about practicality or is it an issue about whether it is legal?
