The Minister talks about the voter expressing a clear preference. The practice in Northern Ireland under the single transferable vote has been that exactly—if a clear preference is shown by an X or a 1. However, new rule 37A(1)(a), in clause 7, says:"““A voter votes by marking the ballot paper with…the number 1 opposite the name of the candidate””,"
so where does that flexibility come in if it is in legislation that the number 1 should be used?
