My Lords, of course we do. The noble Baroness, Lady Carnegy of Lour, drew attention to subsection (6) and asked about the particular purpose of the provision. We always thought that the provision covered asylum seekers for the duration of the in-country appeal, but the Court of Appeal in one case found otherwise. We are of course appealing to the Judicial Committee of the House of Lords on that point. We therefore seek to clarify the issue by confirming the position in Clause 17(6) to cover all cases past and future. The provision is retrospective, but for the benefit of asylum seekers, in that it makes it clear that they have always been entitled to the support described in the clause.
