It will be for the Home Secretary to decide which penalty is appropriate. The considerations with which the noble Lord takes issue can be properly dealt with and, no doubt, the Home Secretary will choose whichever is the most appropriate penalty. The point the noble Lord made—about his notional student, for instance—can be considered in the light of that. I hope that that helps.
