Initially, clause 7 provided grounds for appeal based on dishonesty and bad faith. Consistent with the Shuker judgment, we have now included other ““exceptional circumstances””. In view of the deliberations in the other place, we now confirm that those other exceptional circumstances may include"““lack of jurisdiction or error of law””."
We have now reached the point where the balance is clear and we have clarified all those points in the Bill. I hope that, as I say, that will give us a greater degree of confidence and consensus.
