I understand entirely what the Minister has said about the drafting in Amendment No. 72 and I am sure we will come back to this. It the Minister does not approve of the idea of the super-affirmative procedure as a way of providing a real bite, what about restricting the clause by saying that regulations must be made in response to a real need based on clear evidence, and must be proportionate? Would that sort of restriction be appealing to the Minister?
