moved Amendment No. 3:"After Clause 42, insert the following new clause—"
““OFT GUIDANCE
After section 183 of the 1974 Act insert—
““OFT guidance
No guidance is to be published under the 1974 Act without the approval of the Secretary of State.””””
The noble Lord said: My Lords, this amendment would require that no guidance was to be published under the 1974 Act without the approval of the Secretary of State. In his letter to me, which is available in the Library, the Minister said that the OFT and the DTI work closely and that the OFT already consults the DTI on all such matters, as a matter of course, even where it is not a legislative requirement. That is very helpful, and if he can confirm that for the record, I shall be happy to withdraw the amendment. I beg to move.
