My Lords, I do not know the answer to the noble Lord’s last question but I hope that I will find out what the rights are of someone in that position. But we are talking about claims: no more, no less than that; not claims that are necessarily granted, but claims nevertheless. Amendment No. 140 would cut off any chance of a good claim being positively answered. That is why the Government feel that it is as proportionate, fair and just as it can be to both sides of the argument, bearing in mind that there is a real problem regarding motorised vehicles.
