The Government agree with the spirit of the amendment standing in the names of the noble Lord, Lord Roberts of Conwy, and the noble Lord, Lord Luke, but we believe it is unnecessary. The term ““review”” is inclusive of monitoring activity. Therefore, use of the term in Clause 3 enables the commissioner to review and monitor the discharge of functions of a person listed in Clause 3. So we agree with the noble Lords that the commissioner should be enabled to monitor the discharge of functions by a person listed in Clause 3, but in our view we do not need this amendment to achieve that. I hope the noble Lord is reassured in the light of that explanation and will be willing to withdraw the amendment.
