I thank the noble Earl, Lord Howe, for speaking to our amendments. I said at Second Reading that this clause was ambiguous. I asked the Minister for clarification, and while he wrote to Members of the Committee following Second Reading to clarify a number of points, he did not address this one.
The subject of disclosure is at the very heart of this scheme. It is, therefore, important—and I believe it is important right from the outset in the Bill—that all the participants within the scheme understand what their duty of disclosure is, and to whom. Therefore, I believe that our two amendments are a preferable way of saying what I think Clause 12 is meant to imply. I really would like an explanation.
