The noble Baroness said: The amendment again comes to the core of our concerns about much of the Bill. I may be misreading the Bill, but it seems that there is no real provision for the people concerned to be independent. We want to insert,"““independent of those bodies or other persons as defined in section 1(3) as authorised by the Secretary of State””,"
to force a degree of independence into the consideration. At the moment, the organisations,"““to whose liability a scheme applies””—"
so members of the scheme, arguably—decide whether the case ought to be considered. It would be far better for an independent element to be involved.
I suspect that the Law Society has made representations to a lot of us about the legislation. It was very concerned about the provision and equally concerned that there was a lack of independence in the phrasing. I beg to move.
