The noble Earl said: This amendment is easily dealt with. On Second Reading, the Minister made clear that the Government’s intention was to include foundation trusts in the scope of the redress scheme. It is therefore not wholly clear to me why the Bill does not refer explicitly to foundation trusts in subsection (3). The answer will probably be that foundation trusts are included in the scope of Clause 1(3)(d), being providers of services that are commissioned by primary care trusts. Nevertheless, their legal status being distinct from that of other NHS provider trusts leads me at least to pose the question. In other recent legislation they are explicitly named, and I shall be interested to hear from the Minister why this Bill is different. I beg to move.
