Commons Bill [HL]

I am grateful for the support for the amendments. The noble Lord, Lord Tyler, asked what are the other rights referred to in subsection (9) of the proposed new clause in Amendment No. 182A. By way of example, the other rights—we have touched on them before in our debates—include sporting rights and the reserved rights of holders of mineral rights. They include the rights of people who have an interest in the land but obviously not the right of common. The noble Earl asked how we would resolve a conflict. Basically, if there was a conflict it would be negotiated at the stage when the establishment order for the statutory commons association was being made. The idea is to resolve the conflict at that stage so that all parties know where they stand. That is the best I can do at the moment. On Question, amendment agreed to.
