Returning to the point made by the noble Lord, Lord Tyler, who referred to past practices as determining whether the commons association or the owner should continue to carry out those practices, I am curious as to what determines which particular practice is vested in the owner and which in the grazier. Yes, there are traditional management practices and standards which have built up over the years, but if a conflict were to arise, how would it be determined?
