The two amendments essentially would allow commons associations to undertake a similar activity: to apply for horse passports and to remove horses from the common. However, in the light of our proposed amendments, we do not think that these amendments are necessary. Commons associations will be able to make rules relating to the management of horses and ponies. This will include the removal and disposal of animals found to be grazing unlawfully. The ancillary powers of commons associations set out in Clause 31 would enable associations to apply for horse passports where necessary.
Having said that, these are new rules and the points made by both the noble Lord and the noble Baroness are ones that we would like to take a little time to think about. I shall write to them both with a fuller answer.
