We have concluded that we need to take another look at the drafting of Section 40A of the 1988 Act. Unfortunately, Section 40A is missing from my copy of that Act because I have the original draft of the measure. I am anxious that the new provision may deter a prosecution if the authorities know that the driver already has one conviction as they might not want to ban him from driving. However, at this late hour I beg leave to withdraw the amendment.
