This is a probing amendment but we should be absolutely clear about what subsection (2) means. It states:"““Her Majesty may by Order in Council make such provision as She considers appropriate for the purpose of giving effect to . . . any international agreement . . . which modifies—"
and this is the critical phrase—"““or replaces the whole or any part””."
To replace any part of it is fine, but to replace the whole of it seems to be a rather different situation; it would replace the agreement. The real question is how Parliament is to be consulted about such a change.
